Trespass to land—What is included in the purchase of a house.

Facts

Gladstone Bob Manuel bought at public auction right title and interest of Quaker Bob Manuel in a house.

Held

To say that he acquired a whole area of land thereby was wrong, the purchase of the house carries with it the right to occupy the area covered by the house at any rate so long as the house stands and the right of access to the house but was not effective to cancel other rights of occupancy to various parts of the whole area.

The Respondent is awarded costs in this Court assessed at 35 guineas.
