Statute of Frauds
An Act for prevention of Frauds and Perjuryes.
Sections
Section 1 Statute of Frauds – Parol leases and interests of freehold, etc., to have the force of estates at will only.
Section 2 Statute of Frauds – Except leases not exceeding three years, etc.
Section 3 Statute of Frauds – No leases or estates of freehold or copyhold, etc., to be granted or surrendered but by writing signed.
Ss. 1–3 have been repealed by Law of Property Act 1925
Section 4 Statute of Frauds – No action against executors, etc., upon a special promise, or upon any agreement, or contract for sale of lands, etc., unless agreement, etc., be in writing, and signed.
Ss. 5, 6 have been repealed by Wills Act 1837
Section 7 Statute of Frauds – Declarations or creations of trusts of lands to be in writing signed.
Section 8 Statute of Frauds – Proviso for trusts arising, transferred or extinguished by implication of law.
Section 9 Statute of Frauds – Assignments of trusts shall be in writing.
Ss. 7–9 have been repealed by Law of Property Act 1925
Section 10 Statute of Frauds – Trust shall be assets by descent.
Section 11 Statute of Frauds – But heir shall not by reason thereof become chargeable of his own estate.
Ss. 10, 11 have been repealed by Administration of Estates Act 1925
S. 12 has been repealed by Wills Act 1837
Ss. 13, 14 have been repealed by Civil Procedure Acts Repeal Act 1879
Ss. 15, 16 have been repealed by Sale of Goods Act 1893
Section 17 Statute of Frauds – The day of enrolment of recognisances to be set down; and lands in the hands of purchasers bound from that time only.
S. 17 has been repealed by Statute Law Revision and Civil Procedure Act 1881
Ss. 18–21 have been repealed by Wills Act 1837
Section 22 Statute of Frauds – Proviso for soldiers and mariners wills.
S. 23 has been repealed by Administration of Estates Act 1925
S. 24 has been repealed by Law of Property Act 1925
