1 Texas Administrative Code § 80.26 – Nonprofit Association Name

The name of the nonprofit association in a statement appointing an agent should be the name under which the association regularly conducts its activities in this state. The name of the nonprofit association in the statement appointing an agent should be the name as it appears in the nonprofit association’s governing documents (the association’s constitution, bylaws or regulations) or, if applicable, the name of the association as shown in its assumed name certificate filed pursuant to Business and Commerce Code, Chapter 71. The nonprofit association may not use the term “corporation” or “incorporated” or an abbreviation of either of those terms in its name. The secretary of state does not review the name of the nonprofit association, or a change of name, to determine whether the name conforms with the entity name availability rules of §§ RSA 79.30- RSA 79.54 of this title.
