Section 87 Land Registration Law (LRL) Lagos State 2015
Section 87 of the Land Registration Law (LRL) of Lagos State 2015 provides as follows:
(1) Any person who acquires any land, sub-lease or mortgage in a fiduciary capacity may be described by reference to that capacity in the document of acquisition and be registered with the addition of the words “as trustee”; but particulars of any such trust shall not be entered in the register, and the fact that a person is registered as trustee shall require any person to inquire into particulars of the trust.
(2) Where the holder of land, sub-lease or mortgage is a trustee, he shall hold the same subject to any unregistered liabilities, rights or interests to which the land, sub-lease or mortgage is liable by virtue of the document creating the Trust; but for the purpose of registration of any dealings, he shall be deemed to be the absolute holder of it and the breach of a trust shall create no right to indemnity under this Law.
