Section 6 Rent Control and Recovery of Residential Premises Law

Section 6 of the Rent Control and Recovery of Residential Premises Law of Lagos State 1997 is about Establishment of Rent Tribunals. It provides as follows:

(1) There shall be established in each Local Government area Tribunal for the
purposes of this Law to be called Rent Control Tribunal (hereinafter in this Law
referred to as “the Tribunal”).

(2) The Tribunal shall consist of—
(a) a Chairman who shall be a Magistrate or a Magistrate appointed by virtue of
section 5 of this Law;

(b) one Estate Surveyor and Valuer with not less then 5 years qualification
experience;
(c) a representative of the Landlords Association in the Local Government area; and
(d) a representative of the Tenant Association in the Local Government area.

(3) A member of the Tribunal shall hold office until such a time as the Governor may
determine and any such member, not being a person employed in the public service
of the State, may at any time resign his office by writing under his hand addressed
to the Governor.

(4) The Governor may remove or appoint any person as he may deem fit as the
Chairman or member of the Tribunal.

(5) A Tribunal shall be duly constituted for the purpose of hearing and determining
any application if it consists of the Chairman and the member referred to in subsection (2) of this section.

(6) The remuneration and allowances of the Chairman and members of the Tribunal
shall be as may be determined by the Governor from time to time.
