Section 5 Recovery of Premises Act 1945

Section 5 Recovery of Premises Act 1945 is about Jurisdiction of magistrate in cases of title of third person. It provides as follows:

The jurisdiction of a magistrate shall not be ousted by the defendant bona fide setting up the title of a third person, unless he holds under, or claims through, that third person.
