Section 41 Nigeria Police Act

Section 41 of the Nigeria Police Act 2020 is about Arrest for offence committed in presence of a judge or magistrate. It is under Part VII (Powers of Police Officers) of the Act. It provides as follows:

A judge or magistrate may arrest or direct the arrest of a suspect committing an offence in his presence and shall hand him over to a police officer who shall proceed to take necessary action.
