Section 41 Indian Contract Act 1872
Section 41 of the Indian Contract Act 1872 is about Effect of accepting performance from third person. It is under “By whom contracts must be performed” of CHAPTER IV of the Act. CHAPTER IV is titled OF THE PERFORMANCE OF CONTRACTS.
Effect of accepting performance from third person
When a promisee accepts performance of the promise from a third person, he cannot afterwards enforce it against the promisor.
