Section 364 Administration of Criminal Justice Law (ACJL) Lagos

Section 364 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Mode of proof of service. It provides as follows:

When any summons, subpoena, notice or other process has under the provisions of sections 360 to 368 been served out of the State in which it was issued, such service may be proved—

(a) by affidavit sworn before any Magistrate or Justice of the Peace having jurisdiction in the State in which such service was effected; or

(b) in any manner in which such service might have been proved if it has been effected within the State in which the summons, subpoena, notice or process was issued.
