Section 345 Investments and Securities Act

Section 345 of the Investments and Securities Act 2025 is about Criminal prosecution. It is under Part XVIII (Miscellaneous Provisions) of the Act. It provides as follows:

(1) Subject to the provisions of the Constitution of the Federal Republic of Nigeria, 1999 relating to the power of prosecution by the AttorneyGeneral of the Federation, any legal practitioner in the employment of the Commission may with the consent of the Attorney-General of the Federation, prosecute or defend criminal matters, in the name and on behalf of the Commission in respect of matters relating to the Nigerian capital market in accordance with the objectives of this Act.

(2) Notwithstanding the provisions of any enactment to the contrary, a person appointed under this provision, who is a legal practitioner shall, while so appointed be entitled to represent the Commission as legal practitioner for the purpose and in the course of his employment, without prejudice to the power of the Commission to engage private legal practitioners in any proceedings.
