Section 341 Investments and Securities Act

Section 341 of the Investments and Securities Act 2025 is about Legal proceedings, pre-action notice and right to represent Commission before Court or Tribunal. It is under Part XVIII (Miscellaneous Provisions) of the Act. It provides as follows:

(1) A suit shall not be commenced against the Commission before the expiration of a period of 14 days after written notice of intention to commence the suit shall have been served upon the Commission by the intending plaintiff or his agent, and the notice shall clearly and explicitly state the cause of action, the particulars of the claim, the name and address of the intending plaintiff and the relief which he claims.

(2) A legal practitioner employed by the Commission shall be entitled to represent the Commission before any court or the Tribunal.
