Section 34 Administration of Criminal Justice Law (ACJL) Lagos

Section 34 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Power of Magistrate to require execution of recognisance for keeping peace. It provides as follows:

(1) Whenever a Magistrate is informed on oath that any person is likely to commit a breach of the peace or disturb public peace, or to do a wrongful act that may likely occasion a breach of the peace or disturb public peace, the Magistrate may in manner hereinafter provided, require the person to show cause why he should not be ordered to enter into a recognisance, with or without sureties, for keeping the peace for a period, not exceeding one year, as the Magistrate thinks fit.

(2) Proceedings shall not be taken under this section unless the person against whom information is made is in the State and is within the District to which the Magistrate is assigned or the place where the breach of the peace or disturbance has occurred is within the District to which the Magistrate is assigned.
