Section 310 Investments and Securities Act

Section 310 of the Investments and Securities Act 2025 is about Administrative sanctions. It is under Part XVI (Issuance of Securities) of the Act. It provides as follows:

The Commission may in lieu of criminal prosecution direct a person who diverts or mismanages the proceeds of any debt issuance under this Part to —

(a) restitute to the issuer the total amount diverted or mismanaged; and

(b) pay a penalty to the Commission amounting to 500% of the total amount diverted or mismanaged.
