Section 3 Administration of Criminal Justice Law (ACJL) Lagos
Section 3 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Notification of cause of arrest and rights of the arrested person(s). It provides as follows:
(1) Except when the person arrested is in the actual course of the commission of a crime or is pursued immediately after the commission of a crime or escapes from lawful custody, the Police Officer or other person making the arrest shall inform the person arrested of the cause of the arrest.
(2) The Police Officer or the person making the arrest or the Police Officer in charge of a Police Station or any Law Enforcement Agent, shall inform the person arrested of his rights to—
(a) remain silent or avoid answering any question until after consultation with a legal practitioner or any other person of his own choice;
(b) consult a counsel of his choice before making or writing any statement or answering any question put to him after arrest.
(3) The Police Officer or the person making the arrest shall inform the person arrested that he may apply for free legal representation from the Office of the Public Defender, Legal Aid Council or any such agency.
