Section 248 Administration of Criminal Justice Law (ACJL) Lagos

Section 248 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Effect of judgment of dismissal ‘‘on merits’’, ‘‘not on merits’’ and ‘‘without prejudice.’’. It provides as follows:

(1) Where a charge is dismissed and such dismissal is stated to be on the merits, such dismissal shall have the same effect as an acquittal.

(2) Where a charge is dismissed and such dismissal is stated to be not on the merits or to be without prejudice such dismissal shall not have the same effect as an acquittal.
