Section 228 Administration of Criminal Justice Law (ACJL) Lagos
Section 228 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Delivery of person of unsound mind to care of relative. It provides as follows:
(1) Whenever any relative or friend of any person confined under section 219 or 223 desires that such person shall be delivered over to his care and custody, the Governor, upon the application of such relative or friend, and on his giving security to the satisfaction of the Governor that the person delivered shall be properly taken care of and shall be prevented from doing injury to himself or to any other person, may in his discretion order such person to be delivered to such relative or friend:
(2) Where person is confined under the provisions of section 223, the Governor may further require such relative or friend to give security to the satisfaction of the Governor that if at any time it shall appear to the Governor that such person is capable of making his defence, such relative or friend shall produce
such person for trial.
(3) Whenever such person is so delivered to the care and custody of any person, it shall be upon condition that he shall be produced for the inspection of such officer and at such times as the Governor directs.
(4) Sections 224 and 225 shall apply to persons delivered to the care and custody of persons under this section as far as it is applicable.
