Section 223 Administration of Criminal Justice Law (ACJL) Lagos

Section 223 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Safe custody of person acquitted. It provides as follows:

(1) Whenever the finding states that the defendant committed the act alleged, the Court before which the trial has been held shall, if such act would but for the incapacity found have constituted an offence, order such person to be kept in safe custody in such place and manner as the Court deems fit and shall report the case for the order of the Governor.

(2) The Governor may at his discretion order such person to be confined in a mental health asylum, prison or other suitable place of safe custody.
