Section 197 Property and Conveyancing Law of the Western Region of Nigeria 1959
Section 197 of the Property and Conveyancing Law of the Western Region of Nigeria 1959 is about Payment into court, jurisdiction and procedure. It provides as follows:
(1) Payment of money into court effectually exonerates therefrom the person
making the payment.
(2) Subject to any rules of court to the contrary
(a) Every application to the court under this Law shall, save as otherwise expressly provided, be by summons;
(b) On an application by a purchaser notice shall be served in the first instance on
the vendor;
(c) On an application by a vendor notice shall be served in the first instance on the purchaser;
(d) On any application notice shall be served on such persons, if any, as the court
thinks fit.
(3) The court shall have full power and discretion to make such order as it thinks fit respecting the costs, charges and expenses of all or any of the parties to any application.
