Section 170 Administration of Criminal Justice Law (ACJL) Lagos

Section 170 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Where murder is charged and infanticide is proved. It provides as follows:

(1) Where on the trial of a woman for the murder of her newly-born child it appears from the evidence that having regard to the provisions of the Criminal Law applicable in the State, she was not guilty of murder but was guilty of infanticide, she may be found guilty of infanticide.

(2) Nothing in subsection (1) of this section shall prevent a woman who is tried for the murder of her newly-born child from—
(a) being convicted of manslaughter; or
(b) being found guilty of concealment of birth in pursuance of section 169 of this Law; or

(c) being acquitted upon the ground that by virtue of the provisions of the Criminal Law applicable in the State she was not criminally responsible, and being dealt with under section 223 of this Law.
