Section 11 Administration of Criminal Justice Law (ACJL) Lagos

Section 11 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Refusal to give name and residential address. It provides as follows:

(1) When a person who in the presence of a Police Officer has committed or has been accused of committing an offence triable summarily, refuses on demand of the officer to give his name and residence, or gives a name or residence which the officer has reason, or gives a reason to believe to be false, he may be arrested by the officer in order that his name or residence may be ascertained.

(2) When the true name and residence of the person referred to in subsection (1) of this section have been ascertained he shall be released on his executing a recognisance, with or without sureties, to appear before a Magistrate if so required: But if such person is not resident in the State, the recognisance
shall be secured by a surety or sureties resident in the State.

(3) If the true name and residence of the person cannot be ascertained within 24 hours from the time of arrest, or if he fails to execute the recognisance, or if required to furnish sufficient sureties, he shall forthwith be brought to the nearest Magistrate having jurisdiction by way of a complaint on oath.

(4) If such person upon being brought before the Magistrate still refuses, the Court may deal with him as it would an uncooperative witness under this Law.
