Section 1 Investments and Securities Act

Section 1 of the Investments and Securities Act 2025 is about Establishment of the Securities and Exchange Commission. It is under Part I (Establishment, Objectives, Functions, and Powers of the Securities and Exchange Commission) of the Act. It provides as follows:

(1) There is established the Securities and Exchange Commission (in this Act referred to as “the Commission”).

(2) The Commission —
(a) shall be a body corporate with perpetual succession and a common seal;
(b) may sue and be sued in its corporate name; and
(c) shall have the power to acquire, hold or dispose of any property, movable or immovable for the purpose of performing any of its functions under this Act.

(3) Except as otherwise provided in this Act, the Commission shall be independent in the performance of its functions and objectives under this Act.
