Order 2 FCT (Civil Procedure) Rules 2025
Order 2 of the Federal Capital Territory (FCT) High Court (Civil Procedure) Rules 2025 is about Form and commencement of action. It contains the following rules:
Order 2 Rule 1 FCT (Civil Procedure) Rules 2025 – Mode of commencing Proceedings
Subject to the provisions of any enactment or this Rules, civil proceedings may be commenced by writ, originating summons, originating motion or petition.
Order 2 Rule 2 FCT (Civil Procedure) Rules 2025 – Proceedings to commence by writ
(1) The under listed proceedings shall be commenced by writ except any applicable law requires that the proceedings shall be commenced otherwise, than by writ:
a. Proceedings in which claimant claims:
(i) Any relief or remedy for any civil wrong or
(ii) Damages for breach of duty, whether contractual, statutory or otherwise, or
(iii) Damages for personal injuries to or wrongful death of any person, or in respect of damage or injury to any person, or in respect of damage or injury to any property.
b. Where the claim is based on or includes an allegation of fraud, or
c. Where the claim is for declaration.
Documents Accompanying writ
(2) All civil proceedings commenced by writ of summons shall be accompanied by:
(a) Statement of claim;
(b) List of witness(es) to be called at the trial;
(c) Written statements of the witnesses (except that of a witness on subpoena) numbered in consecutive paragraphs;
(d) Copies of every document to be relied on at the trial.
