This is an appeal against the Judgment of the Osun State High Court Coram O. A. Ojo, Chief Judge, delivered on 30th May, 2022 wherein the appellant was arraigned and found guilty, convicted and sentenced for the offences of conspiracy to kill unlawfully, unlawful killing, conspiracy to indecently interfere with a dead body, conspiracy to unlawfully alter receipt, conspiracy to fabricate evidence and fabrication of evidence as contained in counts 1, 2, 3, 7, 9,15 and 16 of an undated further amended charge filed on 10th June, 2022 by Funmi Falana, Esq., of Falana & Falana Chambers.

The appellant and six co-defendants had earlier been arraigned on an amended eleven count charge dated 22nd February, 2022, but filed on 2nd March, 2022. The appellant and co-defendants were charged more particularly with the following counts:

Count 4

That you, Dr. Rahmon Adedoyin ‘M’, Adeniyi Aderogba ‘M’, Madgalene Chiefuna ‘F’, Oluwole Lawrence ‘M’, Oyetunde Kazeem ‘M’, Adebayo Kunle ‘M’, Adedeji Adesola ‘F’ and others now at large on or between the 5th day of November, 2021 and 7th November, 2021 within the jurisdiction of this honourable court did attempt to commit felony and thereby committed an offence punishable under section 509 of the Criminal Code Cap 38 LFN 2004 as applicable to Osun State.

Count 6

That you Adeniyi Adreogba ‘M’, Oyetunde Kazeem ‘M’, Dr. Rahmon Adedoyin ‘M’, and others now at large on or between the 15th day of November, 2021 within the jurisdiction of this honourable court did conspire amongst yourselves to wit improperly or indecently interfere with the dead body of one Adegoke Timothy and thereby committed an offence punishable under section 516 of the Criminal Code Cap 38 LFN 2004 as applicable to Osun State.

Count 8

That you Dr. Rahmon Adedoyin ‘M’, Adeniyi Aderogba ‘M’, and others now at large on or between the 5th day of November, 2021 and 7th November, 2021 did conspire amongst yourselves to with (sic) altering cancelled the receipt of payment made by Adegoke Timothy and thereby committed an offence punishable under section 516 of the Criminal Code Cap 38 LFN 2004 as applicable to Osun State.

Count 10

That you Dr. Rahmon Adedoyin ‘M’, Kazeem Oyetunde ‘M’, and others now at large on or between the 5th day of November, 2021 and 7th November, 2021 within the jurisdiction of this honourable court did conspire amongst yourselves to wit administering of extra judicial oath and thereby committed an offence punishable under section 516 of the Criminal Code Cap 38 LFN 2004 as applicable to Osun State.

Count 11

That you Dr. Rahmon Adedoyin ‘M’, Kazeem Oyetunde ‘M’, and others now at large on or about 5th, 6th and 7th of November, 2021 within the jurisdiction of this honourable court did administer extra judicial oath on Magdalene Chiefuna F, Adedeji Adesola ‘F’ and other staffs of Hilton Royale Hotel, lie Ife with a view to cover up the murder of Timothy Adegoke and thereby committed an offence punishable under section 106 of the Criminal Code Cap 38 LFN 2004 as applicable to Osun State.

The appellant entered a not guilty plea and the case was set down for trial. At the conclusion of trial and after the lower court had adjourned for hearing of arguments canvassed in the final written addresses of learned counsel on record, the respondent filed an eighteen count further amended charge which was filed on 10th June, 2022; the following counts were preferred against the appellant (the 1st defendant in charge number: HOS/5C/2022) and co-defendants:
