In its judgment delivered on the 21st of March 2014, the High Court of Justice, Kogi State holden at Ebogogo, decided in favour of the respondent who was the plaintiff before it. The claims of the respondent as plaintiff, as seen at pages 23-25 of the record of appeal, are:-

  1. A declaration that the unilateral repudiation of the building contract between the Claimant and the defendant vide the defendant letter dated 30/7/2013 is wrongful and in flagrant violation of the stipulated contract terms and conditions.
  2. The sum of Two Million Naira (N2,000,000) being general damages for breach of contract.
  3. The sum of Four million, Eight hundred and Thirteen thousand, Twelve Naira (N4,814,012) as special damages arising from the specific outstanding balance of the 40% due to the claimant at the first payment after the completion of the first phase of the contract work and the amount spent on labour and building materials used in the second phase of the contract work.
