Section 26 Patents and Designs Act 1971

Section 26 of the Patents and Designs Act 1971 is about Legal proceedings. It is under ‘General’ of the Act. It provides as follows:

(1) Jurisdiction to hear and dispose of legal proceedings under this Act is hereby
vested in the Federal High Court and, subject to this Act, the provisions of the Trade Marks Act applicable to legal proceedings under that Act shall apply with the necessary modifications to legal proceedings under this Act.

(2) The court hearing proceedings under this Act may sit with and be advised by two assessors having expert knowledge of matters of a technological or economic nature.

(3) The Chief Judge of the Federal High Court may make rules of court for the regulation of legal proceedings under this Act if he thinks it necessary to do so.
