Section 46 Trade Marks Act 1967

Section 46 of the Trade Marks Act 1967 is about Duty of Registrar, if required, to hear certain persons. It is under ‘Powers and duties of Registrar’ of the Act. It provides as follows:

Where any discretionary or other power is given 10 the Registrar by this Act or the
regulations, he shall not exercise that power adversely to an applicant for registration or the registered proprietor of a trade mark without (if duly required so to do within the prescribed time) giving to the applicant or registered proprietor an opportunity of being heard.
