Section 19 Trade Marks Act 1967
Section 19 of the Trade Marks Act 1967 is about Publication of notice of application. It is under ‘Procedure for and duration of registration’ of the Act. It provides as follows:
(1) Subject to the provisions of this section, when an application for registration of a
trade mark has been accepted, whether absolutely or subject to conditions or limitations, the Registrar shall, as soon as may be after acceptance, cause notice of the application as accepted to be published in the Journal; and the notice shall set out all conditions and limitations subject to which the application has been accepted.
(2) In the case of an application made under section 9 (l) (e) of this Act, or in any
other case where it appears to him that it is expedient by reason of any exceptional circumstances to do so, the Registrar may cause notice of an application for registration of a trade mark to be published in the Journal before acceptance.
(3) Where, under subsection (2) of this section, notice of such an application has been published in the Journal before acceptance, the Registrar may, if he thinks tit, cause notice of the application to be published in the Journal again when it has been accepted, but shall not be bound to do so.
