Section 11 Trade Marks Act 1967

Section 11 of the Trade Marks Act 1967 is about Deceptive or scandalous matter not registrable. It is under ‘Registrability and validity of registration’ of the Act. It provides as follows:

It shall not be lawful to register as a trade mark or part of a trade mark-

(a) any matter the use of which would, by reason of its being likely to deceive or
cause confusion or otherwise, be disentitled to protection in a court of justice or be contrary to law or morality; or

(b) any scandalous design.
