Section 334 Administration of Criminal Justice Law (ACJL) Lagos

Section 334 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Procedure prior to court recommending deportation under section 332 or 333. It provides as follows:

(1) Where a person required to give security under section 332 default in so doing and the Court contemplates recommending to the Minister of Internal Affairs, the deportation of a person to whom section 333 relates, before making any such recommendation, the Court shall require the person concerned to attend before the Court and, being informed of the allegations made against him, be given an opportunity to show cause why he should not be deported.

(2) After considering the representation, if any, of the person concerned and the facts upon which the proceedings are founded, the Court shall decide whether or not to recommend to the Minister of Internal Affairs that the person concerned be deported.
