Section 214 Administration of Criminal Justice Law (ACJL) Lagos

Section 214 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Plea when offence admitted is included in offence charged. It provides as follows:

Where a defendant pleads guilty to an offence which is included in the offence charged but not guilty of the offence charged, the Court shall follow the provisions of section 213 and if satisfied of the guilt of the defendant may convict the defendant of the offence admitted unless the prosecution states its desire to proceed with the trial of the defendant for the offence stated in the charge.
