Section 116 Administration of Criminal Justice Law (ACJL) Lagos
Section 116 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Security for bail. It provides as follows:
(1) The security for bail in any case shall be at the discretion of the Court, such bail security shall be fixed having regard to the circumstances of the case and shall not be excessive.
(2) The Court may require the deposit of money or any other security as specified by the Court from applicant or defendant and/or the surety before the bail is approved.
(3) Where money is deposited as security for bail, it shall be kept in an interest yielding account by the Chief Registrar of the Court, and at the end of the trial, it shall be disposed in accordance with subsection (4) of this Section.
(4) Such money or any other security deposited shall be returned to the applicant or defendant and/or the surety at the conclusion of the trial or upon an application by the surety to the Court to discharge his recognisance subject to section 129 of this Law.
