Section 78 Administration of Criminal Justice Law (ACJL) Lagos

Section 78 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Particulars of instituting criminal proceedings in Magistrates’ Courts. It provides as follows:

(1) Proceedings in a Magistrates’ Court may be instituted by bringing a person arrested with or without a warrant before the Court upon a charge contained in a charge sheet specifying the name and occupation of the person charged, the charge against him and the date and place where the offence is alleged to have been committed.

(2) The charge sheet shall be signed by a Law Officer or the Police Officer in charge of the case.
