Section 48 Administration of Criminal Justice Law (ACJL) Lagos
Section 48 Administration of Criminal Justice Law of Lagos State, as amended in 2021, is about Procedure on failure of person to give security. It provides as follows:
(1) If a person ordered to give security does not give such security on or before the date on which the period for which the security is to be given commences, he shall be committed to prison, or, if he is already in prison, be detained in prison until such period expires or until within such period he gives
the security to the Court or Magistrate who made the order requiring it.
(2) When a person who has been ordered by a Magistrate pursuant to subsection (1) of this section, fails to give such security, the Magistrate shall commit the person to prison for a period not exceeding one month and the order shall be vacated after the expiration of one month.
(3) If the security is subsequently presented to the officer in charge of the prison, he shall forthwith refer the matter to the Court or Magistrate who made the order and shall await the order of such Court or Magistrate.
