Section 53 Sheriffs and Civil Process Act

Section 53 of the Sheriffs and Civil Process Act 1945 is about Certificate of title to be withheld on s ale to an alien or of a right of occupancy. It provides as follows:

(1) Where the highest bidder at a sale is an alien for the purposes of the Land Use Act who, were it not for the provisions of that Act, would be held to be the purchaser, a certificate of title under section 50 of this Act, not issue unless and until the approval of the Governor is signified in accordance with the terms of that Act.

(2) Where the property sold in execution is a right of occupancy under the Land Use
Act, a certificate of title under section 50 of this Act shall not issue unless and until such consent to the alienation of the right as is required by that Act shall have had and obtained.
