Section 78 Matrimonial Causes Act 1970

Section 78 of the Matrimonial Causes Act 1970 is about Appeal from court of summary jurisdiction. It provides as follows:

Subject to section 77 of this Act, where-
(a) a maintenance order is registered in a court of summary jurisdiction under section 91(1) of this Act; and

(b) in relation to the maintenance order – (i) that court makes any order or does any other thing by way of enforcement of the maintenance order; or (ii) that or another court of summary jurisdiction makes an attachment of earnings order under paragraph 4 of the Third Schedule to this Act, then, without prejudice to any right of appeal which may exist against the making of the maintenance order, there shall exist in respect of the order made or other thing done by the court such rights of appeal (if any) as would have existed if the order had been made or the other thing done in the exercise of the court’s ordinary civil jurisdiction.
