Section 351 Investments and Securities Act
Section 351 of the Investments and Securities Act 2025 is about Removal of appointees and cancellation of registration. It is under Part XVIII (Miscellaneous Provisions) of the Act. It provides as follows:
(1) The Commission may in the interest of investor protection or public interest, by notice suspend or terminate the appointment of the director or officer of a capital market operator or public company, if the director or officer has failed or refused to comply with the provisions of this Act or is no longer a fit and proper person to hold the office.
(2) The Commission may suspend or cancel the registration granted to a capital market operator who violates the provisions of this Act provided that no cancellation shall be made unless the person concerned has been given an opportunity of being heard.
