On 13th November 2013, by a ruling delivered by this Court coram Uwani Abba Aji, Philomena M. Ekpe and Peter Olabisi Ige JJCA, this Court dismissed appeal no. CA/OW/144/2010 pursuant to the provisions of Order 18 Rule 10 of the Court of Appeal Rules 2011.

In this application the applicant has asked this Court to set aside that ruling and relist the appeal. As stated by Mr. Madu, this Court lacks the competence to review or relist an appeal dismissed pursuant to Order 18 Rule 10 of the Court of Appeal Rules.

This motion is struck out for want of competence.
