Miss Obinani: Moves her motion pursuant to Order 8 Rule 18 of the Court of Appeal Rules 2011. Relies on all the paragraphs of the affidavit in support.

Mr. Anyanwu: Says he leaves it at the discretion of the Court.

Court: The appellant had at the Court below in Suit No. Hos 61/2012 challenged the jurisdiction of the Abia State High Court to hear the matter before it. That court ruled that it had jurisdiction. The appellant dissatisfied filed this appeal on 2-4-14.  

It thereafter obtained an order staying proceedings in that Court. It thereafter went to bed.
The record of appeal is yet to be compiled and transmitted to this Court.

The Respondents have argued this application. They are entitled to the order sought.

This appeal is dismissed pursuant to Order 8 Rule 18 of the Court of Appeal Rules 2011.
